LEGAL NOTICE FOR THE VAL D’ISERE MOBILE APPLICATION
The Val d’Isère application is produced by the Société des Téléphériques de Val d’Isère (STVI), a simplified stock company with capital of €2,737,800, entered on the Chambéry Trade and Companies Register under number 380 241 513, whose intra-community VAT number is FR 89380241513 and with registered offices at Gare Centrale des Téléphériques 73150 Val d’Isère (tel: 04 79 06 00 35; email: email@example.com). The Publications Director is Olivier Simonin, in his capacity of CEO of STVI.
The Val d’Isère application is hosted by OVH, with registered offices at 2 rue Kellermann 59100 Roubaix (tel: 09 72 10 10 07).
GENERAL CONDITIONS OF USE FOR THE VAL D’ISERE MOBILE APPLICATION
The purpose of these General Conditions of Use (subsequently referred to as “GCU”) is to establish the rules for using the “Val d’Isère” mobile application (subsequently referred to as the “Application”) produced by the Société des Téléphériques de Val d’Isère (subsequently referred to as “STVI”).
Use of the Application implies unconditional acceptance of the GCU by the user.
ARTICLE 1. PURPOSE OF THE APPLICATION
The Application enables the user to access information and services relating to resort and ski area of Val d’Isère.
STVI reserves the right to change the list and content of the Application functionalities at any time without prior notice.
ARTICLE 2. ACCESS TO THE FONCTIONALITIES OF THE APPLICATION
To access the Application functionalities, the user must:
1. Have a mobile device (smartphone or tablet) with iOS (version iOS 9 or 10) or Android (Lollipop, Marshmallow, Nougat) operating software and Internet access;
2. Download the Application from the App Store or Google Play Store download platform;
3. Create a personal account.
ARTICLE 3. AVAILABILITY OF THE APPLICATION
The Application is accessible 24/7, except in cases of force majeure, breakdown and maintenance operations. Maintenance operations may be carried out any time without prior notice.
ARTICLE 4. USE OF THE APPLICATION
The user undertakes:
ARTICLE 5. MANAGING THE SETTINGS
The user can manage Application settings by clicking on the “Settings” button on the Application “Home” page.
The user can give details of the members of their group, stating the number of adults and the number and age of the children in the group. This enables the user to obtain information about activities available in the ski area that is appropriate for the members of the group.
AARTICLE 6. INTELLECTUAL PROPERTY
STVI is the holder or licensee of the intellectual property rights to the Application and its constituent elements.
STVI grants the user a non-exclusive, non-transferable, global, revocable and free licence to use the Application.
The user is specifically prohibited from undertaking any copy, extraction, reproduction, adaptation, modification, translation, transcription, arrangement, compilation, decompilation, assembly, disassembly, transcoding, reverse engineering, export, use of source code or merging of all or part of the Application or its constituent elements without express permission from STVI beforehand.
ARTICLE 7. PERSONAL DATA
Data collected on the “Create Account” page of the Application undergoes computer processing for the purposes of creating and managing personal user accounts and to enable STVI to produce statistics on the use of the Application. It is compulsory to provide this data.
Data collected on the “Settings” page of the Application undergoes computer processing to enable STVI to carry out operations relating to the management of current and potential customers (conducting satisfaction surveys and producing statistics etc.). It is compulsory to provide this data.
User GPS data is collected to enable STVI to send them push messages relating to information about events at the resort when they are in the resort or ski area. The user must give permission to send push messages beforehand. They may withdraw consent by changing the settings on the “Settings” page of the Application.
STVI is responsible for data processing and is the recipient of the data collected.
In compliance with the Data Protection Act of 6 January 1978, modified in 2004, the user has the right to access, change and delete and personal data held on them, which they may exercise by emailing STVI at firstname.lastname@example.org or writing to it at the following address: STVI, Gare Centrale des Téléphériques, 73150 Val d’Isère.
ARTICLE 8. FINANCIAL CONDITIONS
Downloading the Application and access to and use of its functionalities are free, apart from any account charges made by phone service providers and Internet connection charges.
ARTICLE 9. LIMITATION OF LIABILITY
STVI cannot be held liable for:
ARTICLE 10. CHANGES TO THE GCU
The GCU applicable are those in force when the user logs onto and uses the Application.
STVI reserves the right to change all or part of the GCU at any time without prior notice. The user will be informed of any new version of the GCU being posted on line the first time they log on to the Application after this has happened. They will be asked to read and accept the new version of the GCU. If they do not accept, the user will no longer be able to use the Application.

ARTICLE 12. LANGUAGE
Should there be any variation between the GCU in French and the GCU in English, the GCU in French shall take precedence.
ARTICLE 13. APPLICABLE LAW
The GCU are subject to French law.
